You are not allowed to copy, or modify/edit the application in full or in part or use our logo or a logo resembling to the one of ours in any way. You’re not allowed to attempt or try to attempt or to extract the source code of the app, in any way directly or indirectly or through known or unknown channels and you also shouldn’t also attempt to translate the app into other languages, or make derivative versions which are /is similar to our application. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, strictly belongs to the company Maraekat Infotech Ltd.
We reserve our right to change the Terms and Conditions mentioned above fully or partially as per the demands of the application, its operational and commercial requirements. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These terms and conditions are effective as of date of accepting this terms and conditions.
User Agreement
This user agreement (“User Agreement”) between “ShowTalent” and you (“User”, “You” or “Your”) in relation to your access to and use of the Services and shall be read in conjunction and together with the Privacy Policy.Maraekat Infotech Ltd is committed to ensuring that the app is as useful and efficient as possible. Maraekat Infotech Limited will have complete freedom to update the application to correct mistakes or to improvise on the features or speed of the application. Maraekat Infotech Ltd should not be held responsible for any errors/omissions/acts of God, as these can appear abruptly and we do not have any control on the same. Maraekat Infotech Ltd, will have the freedom to change or alter the terms and conditions at any time if such changes are required by the users, government authorities/statutory bodies etc, and will be intimated to you while logging on to the application. Maraekat Infotech Ltd will also have the rights to alter the commercial terms of usage depending upon the demands of the business.
By signing this terms and conditions, you are agreeing to the below cited important conditions, you need to comply with at all times.
Terms of Use
1.This User Agreement governs Your access of the Services and any features, branding, data, message, text, image, photographs, graphics, audio, sound, voice, codes, computer programmes, software, database, service information, any form of content available through the Service, as well as the interactive elements/features etc. that You utilize and host, publish, share, transact, display, upload and/or engage with in the course of accessing and using the Services.2.Show talent contest and content sharing platform is offered and made available only to the users above the age of 18 years. By downloading and creating an account with this App, you represent and warrant that you are above the age of 18 years. Your access to and use of the Services is conditioned on your acceptance of and compliance with the user Agreement and the Privacy Policy. By accessing or using the services You agree to be bound by the User Agreement. We may also use any third-party API services/SDK in some of our features as permitted under the terms of such third-party policies, that means if You are using the Service which makes use of any third-party API/SDK services, then You are agreeing to the terms of service/use of such third party as well.
With respect to Maraekat Infotech Ltd responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Maraekat Infotech Ltd accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
3. ShowTalent allows users to post, upload, transmit, share, store messages, texts, images, photographs, graphics, audios, sound, voice, videos and all other kinds of “User Content”, connect with other users of different Groups inside the App, sending messages to other users or connect with other users when they are your group members. The app also gives you an option to upload or record images, video, audio etc. as part of your Content. The user content should at all times, be compliant with the standards set out hereunder in this user Agreement. If the user content includes any third-party materials (while creating contest banners or sending posts within the groups) including brands, trademarks, logos, photos, videos etc. any “Branded Content” then you are required to procure necessary permissions, licenses directly from such third parties and will not upload any Branded Content without the required permissions of same else ShowTalent shall have the right to takedown the Branded Content or remove third party brands, trademarks, logos etc. from such Branded Content, at its sole discretion.
4. In order to use the services on Show Talent app it is mandatory that you will have to register on the Platform by providing certain details about yourself, including Your name, email address, phone number and such other details as may be required and create an account. You may register on the Platform by logging into your account with your credentials from certain third-party email networks or social networking sites. You hold responsibility and confirm that you are the owner of such third-party social network accounts and you are authorised to disclose this information on this platform. It is your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Show Talent app will not work properly or at all.
5. You must ensure that your profile is having accurate and right information. If you provide any false information, suspicious or inaccurate then ShowTalent has the right to suspend or terminate such accounts.
6. You must be responsible to keep your account secure and you must may be held liable for losses incurred by ShowTalent or any other user of or visitor of the platform due to authorized or unauthorized use of your registered account as a result of your failure in keeping your account information secure and confidential.
7. With respect to Maraekat Infotech Ltd responsibility for your use of the app, when you are using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Maraekat Infotech Ltd accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
8. You may take a note that without active internet connection, the application may not work properly and hence an active WIFI or data connection is required, without which the application will fail to work, and hence we will not be responsible for the partial working of the application or delayed working of the application due to connectivity, storage or any other technical issue.
9. If you are using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you are accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e., region or country) without turning off data roaming. If you are not the bill payer for the device on which you are using the app, please be aware that we assume that you have received permission from the bill payer for using the app. Please note that Maraekat Infotech Ltd will not be liable/responsible for any such usage/ charges applicable on your cell phone.
10. Along the same lines, Maraekat Infotech Ltd cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Maraekat Infotech Ltd cannot accept responsibility.
11. It is important that you update the latest version of the application and stay updated on your cell phone, otherwise you may not get many features or debugged/updated application on your phone. If the application you download is not functioning on your phone, Maraekat Infotech should not be held responsible. Maraekat Infotech Ltd does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, we may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
By signing this terms and conditions, you are agreeing to the below cited important conditions, you need to comply with at all times.
Acceptable Use
You agree that in connection with the use of the Service and Platform, You will not:
1. Take any action (even if requested by another person or user ) that is, or submit, host, post, display, upload, modify, publish, transmit, update, share, or communicate anything that is, or that incites or encourages, action that is, explicitly or implicitly: illegal, grossly harmful, abusive, harassing, threatening, hateful, racially or ethnically objectionable, derogatory, harmful to any reputation, disparaging, defamatory, libellous, pornographic, indecent, profane, obscene, paedophilic or otherwise objectionable (including nudity), blasphemous, invasive of another's privacy, or relating or encouraging money laundering or gambling or otherwise unlawful in any manner;
2. collect money from anyone for any Participation in Contests
3. send communication that deceives or misleads the addressee about the origin of such messages or communicates any information which is offensive or menacing in nature.
4. stalk, harass, threaten, harm or impersonate any third party.
5. participate in any fraudulent or illegal activity, including phishing, money laundering, or fraud.
6. send communication that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
7. publish any content or any other photo, video, audio, image or any other information that belongs to any third person and in which You do not have any rights.
8. Violate any law, regulation or court order including the local laws of your jurisdiction.
9. Harm minors in any way.
10. Infringe any patent, trademark, design, copyright or other proprietary rights or violate any right of any third party, including privacy rights, publicity rights, and intellectual property rights.
11. publish any content or any other information that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.
12. Advocate, encourage, or assist any third party in doing any of the foregoing.
13. Not use this application with mal-a-fide intentions to tarnish the image of any person(s)/and or groups.
14. Attempt to create accounts or access or collect information in unauthorized ways. This includes creating accounts or collecting information in an automated way without our permission in writing.
Contests, Events and Promotions
Any and all contests, promotions, events and campaigns hosted or conducted on the platform are subject to separate contest terms and conditions which is defined in each and every contest, promotion and event in the App. You must read the Contest T&Cs as well as User Agreement before participating in any contest or event conducted by the platform and upon participation it shall be deemed that the participant has read and understood the terms and conditions of Contest, Promotion and/or event.
